To the fullest extent permitted under South African law, Santum AI disclaims liability for any loss, harm, or damages arising from use of or reliance on the Services.

You confirm that information you provide through Santum AI is accurate, true, current, and complete. You agree to maintain and update this information so it remains accurate, current, and complete.

You are responsible for maintaining the confidentiality of your device, password, email address, and other security information related to your account. You agree to notify Santum AI immediately of unauthorized use of your device or account.

You agree that Santum AI will not be liable for loss or damage caused by someone else using your device or account, with or without your consent or knowledge. You are responsible for all activities performed using your account access.

• You must comply with applicable laws, including POPIA.
• You must not use another person's Santum AI account or use the Services on behalf of another person or organization.
• You must not interfere with Santum AI systems, services, servers, networks, or infrastructure.
• You must not use Santum AI to post, send, or deliver unsolicited advertising, malicious code, unlawful content, abusive content, privacy-invading content, infringing content, or content that may cause harm or encourage criminal activity.
• You must not violate any applicable local, national, or international law, statute, regulation, or ethical code.
• You agree to indemnify Santum AI against claims, losses, liabilities, costs, or expenses arising from your access to or use of the Services, your account activity, your breach of these Terms, non-payment, or your violation of third-party rights.
• You confirm that payment methods used through Santum AI are authorized, accurate, current, and correct, and you authorize Santum AI to bill and charge applicable fees and plan charges.

Santum AI uses automated systems, including artificial intelligence and machine learning models, to provide features such as conversational support, content generation, user interaction analysis, and service personalisation.

By using Santum AI, you acknowledge that your interactions may be processed by AI Systems and not exclusively by human professionals. AI-generated responses are produced algorithmically and may not always be accurate, complete, or appropriate to your specific circumstances.

AI Systems do not constitute licensed medical, psychological, or healthcare professionals unless explicitly stated. Any information provided by AI Systems is informational and supportive only and does not replace professional advice, diagnosis, or treatment.

• Information you provide, including potentially sensitive or health-related data, may be processed to generate responses, improve contextual understanding, and enhance performance, safety, and quality.
• Where information constitutes special personal information under POPIA, Santum AI processes it with explicit consent and/or as otherwise permitted by law.
• Santum AI may use automated processing to personalise user experience, recommend content or services, and optimise system performance.
• Santum AI does not make legally binding decisions about users solely based on automated processing without appropriate safeguards.
• De-identified, aggregated, or anonymised interaction data may be used to train and improve AI models and service quality.
• Human oversight may include quality and safety review or escalation pathways where necessary, but not all interactions are monitored in real time.
• AI outputs may contain errors, omissions, or unintended content, may not fully understand context or nuance, and may vary in performance.
• Users must not rely on Santum AI for emergency situations, psychiatric or medical diagnosis without professional verification, or decisions where inaccurate information could result in harm.
• Users are responsible for the information they share and should avoid disclosing unnecessary or excessive sensitive personal data.

The Services may include links or references to third-party websites or services not owned or controlled by Santum AI. These are provided for convenience only.

Santum AI does not endorse or control third-party services, is not responsible for their content, accuracy, security, or privacy practices, and is not liable for loss or damage arising from use of such services.

Your interactions with third parties are solely between you and those parties. You are responsible for reviewing their terms and policies before use.

Santum AI processes personal information in accordance with its Privacy Policy and applicable South African law, including POPIA.

By using the Services, you consent to such processing where lawful and necessary for service delivery and improvement. The Privacy Policy is deemed part of these Terms of Use.

The Services are intended for users aged 18 and older. Users under 18 may only use the Services with appropriate parental or guardian consent where required by law.

Santum AI does not knowingly collect personal information from children under 18. If such data is discovered, it will be deleted where required by law.

Santum AI offers access through Free, Standard, and Premium plans. Features, pricing, and usage allowances may be described on the Santum AI platform and are incorporated into these Terms by reference.

The Free Plan provides limited access at no cost and may be subject to limits on session duration, frequency of access, token volume, or message volume. Santum AI may modify or suspend Free Plan access at any time.

The Standard Plan is a paid monthly subscription with enhanced access relative to the Free Plan, but remains subject to defined usage limits that may be adjusted from time to time upon reasonable notice.

The Premium Plan is marketed as providing unlimited access. Unlimited refers to the absence of fixed session duration caps, but use remains subject to a reasonable use standard.

Reasonable use may consider typical user behavior, system integrity, fair access for other users, and prevention of misuse. Excessive use may include continuous conversations, automated interactions, bulk querying, disproportionate prompting, or activity that places undue load on the system.

Santum AI may modify plan features, pricing, and usage limits at any time, subject to applicable law. Continued use after changes constitutes acceptance of updated terms.

You may stop using the Services at any time and may request account deactivation where applicable.

Santum AI may suspend or terminate access at its discretion, including where you breach these Terms, where misuse is suspected, or where security, legal, or operational risks arise.

Santum AI may delete associated data upon termination, subject to legal obligations under POPIA. Certain provisions, including liability, indemnity, and intellectual property provisions, survive termination.

Santum AI may update, modify, suspend, or discontinue parts of the Services at any time to improve functionality, security, compliance, or user experience.

Where reasonably possible, Santum AI will provide notice of material changes, though this may not always be practical. Santum AI may also remove content where required for safety, legal compliance, or policy enforcement.

Santum AI depends on power, software, hardware, tools, equipment, and suppliers. While effort is made to maintain reliability and accessibility, no online platform can be guaranteed to be uninterrupted, consistent, timely, accessible, or error-free at all times.

Santum AI website content is developed, serviced, and maintained by affiliated and outsourced providers such as developers, coders, designers, copywriters, ISPs, maintenance providers, hosting providers, and IT support companies.

Although effort is made to ensure content is authentic and copyright free, Santum AI will not be held liable for erroneous, unauthorized, or unsanctioned material posted on its site.

Santum AI respects the intellectual property rights of others and expects users to do the same. In accordance with the DMCA, Santum AI will respond promptly to notices of alleged infringement reported to it.

If you are a copyright owner or authorized to act on behalf of one, you may report alleged copyright infringements taking place on or through the website by sending a notice that complies with the following requirements.

• Identify the copyrighted works claimed to have been infringed.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.

Santum.net is provided and operated as a separate and independent service from Santum AI, notwithstanding any integration, interoperability, shared branding, or access pathways that may exist between the platforms.

Access to and use of Santum.net are governed exclusively by the Santum.net Terms of Use and Santum.net Privacy Policy, which are separate from and in addition to these Terms.

Santum AI and Santum.net may act as separate data controllers or independent responsible parties under relevant data protection laws, including POPIA. Any sharing of personal information between the services will be conducted in accordance with applicable law and each party's privacy policies.

Santum AI does not assume responsibility or liability for Santum.net operation, availability, content, outputs, or data handling practices except where required by applicable law. In the event of conflict, the Santum.net agreement applies solely to Santum.net, while these Terms continue to govern Santum AI.

The Services are provided as is and as available. Santum AI makes no warranties, express or implied, regarding accuracy, reliability, availability, or fitness for any purpose.

To the fullest extent permitted under South African law, Santum AI is not liable for indirect, incidental, consequential, or punitive damages, including loss of data or profits. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

• You agree to indemnify and hold harmless Santum AI, its directors, employees, and affiliates from claims, damages, losses, or legal costs arising from your use or misuse of the Services.
• You agree to indemnify Santum AI for claims arising from your breach of these Terms.
• You agree to indemnify Santum AI for claims arising from content you submit or share.

You may not transfer or assign your rights under these Terms without prior written consent. Santum AI may assign its rights where necessary for business or operational reasons.

If any provision is found unenforceable under South African law, the remaining provisions remain valid and enforceable.
